With this Privacy and Cookies Policy (the “Policy”), CINE TOOLS S.L. (the “COMPANY”) informs the User regarding the processing of personal data obtained from the User, and informs the Visitor/User regarding the cookies used in the website www.cinetools.es (the “Website”), whose titleholder is the COMPANY.

The mere access to the Website confers the condition of “Visitor” and the acquisition of the products available in this Website confers additionally the condition of “User”.

In accordance with Regulation (UE) 2016/679 of April 29 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (and other applicable law regarding personal data protection), and with the Law 34/2002 of the Services of Information Society and Electronic Commerce, this Policy includes the necessary information for the User, to previously and freely, to be able to decide: (i) if he wishes to provide the personal data that may be required because of the acquisition or register in the services that the COMPANY provides through the Website, and (ii) if he wishes to consent to the processing of his personal data.

3 - Data gathered

In the event that a Visitor decides to register as a User in the Website, he will be asked to provide the information detailed in the corresponding form of the Website. Said personal data includes, among other data, name, surname, date of birth, telephone number, e-mail address, a password which will protect the account against non-authorised users, or an address for shipments.

The corresponding form will indicate which personal data are in any case mandatory. The information requested will be given by the User voluntarily.

The User is informed that the COMPANY may obtain his IP address for the purpose of providing an additional level of security against fraudulent use of credit cards.

Visitors who do not register in the Website, will still be able to access its contents. However, the COMPANY will not provide them with those services that require that information for its effective provision, being necessary to create an account and give the mandatory requested data with the aim of contracting the corresponding services and products.

In general, the COMPANY will use the personal information of the Users with the aim of providing the products and services it offers through the Website, and improving the Users contracting experience.

5 - Legal basis for the processing

6 - Responsibility of the User and recommendations

The User will be responsible for the safety of his/her password. The Users must not share their password.

7 - Capacity to contract

In the event that the User is a minor or legally incapacitated, the COMPANY warns that it is required the prior consent by the parents, guardians or legal representatives in order to carry out communications with the COMPANY. Consequently, please refrain from sending electronic communications without having obtained the consent of parents, guardians or legal representatives; otherwise, the COMPANY will not be held liable for the actions of the minor or of the legally incapacitated being made without said consent.

Notwithstanding the foregoing, the COMPANY informs that the User must be older than 14 years in order to perform electronic communications with the Company, authorizing the User the treatment of its personal data in accordance with the present Policy.

8 - Period for which the personal data will be stored

The COMPANY shall store the personal data only to the extent they are necessary for the purpose for which the were obtained, and in accordance with the legal base for their processing.

The COMPANY shall store the personal data as long as there is a contractual or commercial relationship with the User, and as long as the User does not exercise his rights to erasure, cancellation or restriction, or retires his consent.

In said events, the personal data shall be duly blocked, during the legal periods, and without being used, as long as they may be necessary for the COMPANY to exercise its defence right before possible claims, or in case legal, judicial or contractual responsibilities arise and they need to be attended by the COMPANY, and for which the COMPANY may need the recovery of the personal data.

9 - Rights of the User

The COMPANY informs the User that he may exercise his rights of accession, rectification, erasure, cancellation, opposition, restriction and portability, as well as revoke his consent and eliminate his account, at any time (and without said revocation affecting the processing made previously), at the following email account: info@cinetools.es or by means of written communication to CINE TOOLS, S.L. addressed at calle Labrador number 5, C.P. 28005, Madrid, Spain, indicating in any event the right that the User wishes to exercise and attaching a copy if his Spanish ID Card or similar document legally valid for accrediting his identity.

If the User does not obtain a satisfactorily response, he may address to the Spanish Data Protection Agency (addressed at calle Jorge Juan number 6, C.P. 28001, Madrid, Spain / www.agpd.es) in order to obtain additional information or, where appropriate, submit a complaint.

10 -Security measures

The COMPANY agrees to comply with its secrecy obligation regarding personal data and its obligation to store such data adopting the security measures imposed by the regulation in force to avoid its alteration, loss, treatment or unauthorized access. However, the User must be aware that the safety measures in Internet are not impregnable.

CINE TOOLS informs the User that it has adopted all the technical and organisational measures in order to ensure the safety of the personal data, taking into account the state of technology, the nature of the hosted data and the exposure risks, and that it will only register the personal data in files which meet the conditions determined in the applicable legislation.

11 - Recipients of the personal data

The COMPANY is the recipient of the personal data obtained from Users, without prejudice that, for its processing, the COMPANY may rely on certain processors for the purposes of guaranteeing the correct delivery of the services. Said processors undertake to use the data under confidentiality and in accordance with the purpose for which they have been obtained.

In case the COMPANY decides to communicate the personal data to third parties, the Users will be informed about the purpose of the file, transferred data and the name and address of the transferee, so that the User may give his prior consent at this respect.
